About This Agreement

3. Our Services

• The site cannot guarantee Providers will contact Prospects or provide assistance
• Providers may not respond with quotes until obtaining additional information
• The site receives compensation from Providers when displaying advertisements or when users submit forms
• Services and products may not be available in all states
• The site does not guarantee specific terms or conditions with any Provider

Providers may obtain, verify, and record identifying information to combat identity theft, terrorism funding, and money laundering, including name, Social Security Number, driver's license number, address, and date of birth.

4. Personal Use

The site grants you a limited, revocable, non-exclusive license to access the public portions to view or make inquiries. Providers receive a limited license to access password-protected portions. Prohibited uses include:

• Collection, aggregation, copying, duplication, display, or modification of the Site or Service
• Data mining, robots, spiders, or similar data extraction tools without prior written permission

Limited exceptions exist for general-purpose search engines and non-commercial public archives that comply with robots.txt files and use stable IP addresses with identifiable agents.

5. Proprietary Rights and Downloading Information

The Site and its Content (text, files, images, photos, maps, materials) are protected by copyright as a collective work. Content is for personal use only per the limited license. 7. Changes to Site

8. Data Transmittal

You acknowledge the site may store and process data at locations within and outside the United States. You consent to information transfer to the United States and agree transactions are deemed to occur there.

9. Identity Verification

When you provide online IDs and passwords, you authorize access by that person, and you are responsible for all transactions, including fraudulent ones. The site does not warrant that functions are uninterrupted or error-free, that defects will be corrected, or that the server is free of viruses or harmful components. Some jurisdictions do not allow implied warranty exclusions, so these exclusions may not apply to all users.

12. Release

If you have disputes with other Site users (including between Providers and Prospects regarding transactions), you agree to release and discharge the site and all members of the Site Group from any rights, claims, complaints, suits, demands, causes of action, proceedings, liabilities, obligations, legal fees, costs, and disbursements of any nature arising from, relating to, or connected with disputes and/or Site or Service use. California residents waive California Civil Code Section 1542 regarding general releases. Residents of other states explicitly waive similar statutory protections.

13. Indemnity

You agree to indemnify, defend, and hold the Site and Site Group members harmless from liability and costs (including attorneys' fees) incurred in connection with claims arising from: Site use; your acts or failures to act; breaches of Terms or representations, warranties, and covenants. You must cooperate fully in claim defense. The site reserves the right to assume exclusive defense and control at its own expense, and you cannot settle matters without prior written consent.

14. Dispute Resolution

Arbitration

If disputes arise between you and the site (or between you and data purchasers) concerning Terms, breaches, submitted data, the Site, Service, or other products or services, you agree to submit disputes for resolution by arbitration before the American Arbitration Association per its current commercial arbitration rules and consumer-related dispute procedures (“AAA Rules”), as modified by these Terms. A single arbitrator administers arbitration. Awards are final and conclusive; judgments may be entered in competent courts.

Arbitration is in a location convenient to you when disputes involve data purchasers; otherwise in Columbia, Missouri. You may opt out by notifying the site in writing at BetterBathQuote, 1601 S Providence Rd, Columbia, MO 65203 within thirty (30) days after submitting involved data.

Class-Action Waiver

To the extent permitted by law, you agree you will not bring, join, or participate in class action lawsuits, class-wide arbitration, representative claims, or consolidated claims against the site or affiliates (or data purchasers regarding data-related causes of action). The arbitrator cannot consolidate claims or preside over representative proceedings unless both parties agree.

Forum for Certain Disputes Not Arbitrated

If disputes arise and arbitration provisions become inapplicable or unenforceable, parties agree jurisdiction and venue are exclusively in Columbia, Missouri state and federal courts.

15. No Agency

The relationship between the site and each user is independent contractor status; no agency, partnership, joint venture, employee-employer, or franchisor-franchisee relationship is created.

16. Notices

17. Amendments

The site reserves the right to change, modify, add, or remove any Terms portion at any time. Revised Terms are posted on the Sites and become effective immediately. Your submission of inquiries and/or Site use following posting constitutes acceptance of amendments.

18. Copyright Infringement

The site respects intellectual property rights and requires users to do so. Only DMCA notices go to the Copyright Agent; other feedback and requests should be directed to customer service.

20. Miscellaneous

These Terms are governed by United States and Missouri law without regard to conflict of law principles. Claims or causes of action must be commenced within one (1) year after arising. The site's failure to enforce Terms provisions does not constitute waiver. If any provision is unenforceable, it shall be enforced to the maximum extent possible; remaining provisions continue in full force. You cannot assign rights or delegate obligations; the site may assign or delegate these Terms in whole or part.
